Criminal Practice – Murder – Involuntary Manslaughter – Jury Instruction Requested – Correctly Denied (access required)

State v. McKnight Even though defendant contends the victim grabbed for defendant’s gun, causing it to go off, defendant was not entitled to a jury instruction on involuntary manslaughter since defendant admitted he was angry, told the victim he was going to kill him, exited the house, returned with a gun, kicked open one door and shot open another door, and aimed the gun at the wheelchair-bound victim. We affirm the trial court’s denial of defendant’s request for an instruction on involuntary manslaughter.
