Real Property – Tidelands – High Water Mark – 1696 & 1786 Grants (access required)

Grant v. State Neither a 1696 grant nor a 1786 grant of the island of Folly Beach uses the language necessary to convey tidelands below the high water mark to the private owners; furthermore, a map accompanying the 1786 grant that outlines the tidelands along with the island is insufficient to change the outcome. We affirm the trial court’s judgment that the state holds title to the tidelands abutting plaintiff’s property on Folly Beach.
