North American Rescue Products, Inc. v. Richardson Even though the parties signed an agreement purporting to terminate their other agreements - other than a stock purchase agreement that was never reduced to writing - and even though the signed agreement included a merger clause, defendant, his wife, and his former attorney all testified that the signed agreement was only a single portion of a three-step agreement between the parties. There may be a basis for the fact-finder to reject such testimony, but that credibility determination lies with the jury. We affirm the trial court’s denial of plaintiff’s motion for a directed verdict. We affirm the jury award setting the stock price at $2,936,300.
