SC court: Nearby property owners can sue over contamination

MYRTLE BEACH, S.C. (AP) — The South Carolina Supreme Court says those who own property near the plant formerly run by electronics manufacturer AVX Corp. in Myrtle Beach may sue over groundwater pollution.

The Sun News of Myrtle Beach reports that the justices on Wednesday overturned a lower court decision dismissing a suit.

The high court heard arguments in January of last year in the case of the property owners whose land is located near other tracts that were polluted, although their land itself was not polluted.

A circuit judge had earlier dismissed the claims, refusing to hear evidence that property values have dropped and residents were refused bank loans. But the justices ruled a trial should be held.

Groundwater nearby has been contaminated with an industrial degreaser that can cause health problems.
