Charleston attorney suspended

Attorney: John B. Kern

Location: Charleston

Bar membership: Member since 1994

Disciplinary action: Suspended from the practice of law until further notice on May 24

Background: The Supreme Court suspended Kern’s license to practice law until further order and appointed a special receiver to assume responsibility for his client files and law office accounts to protect the interests of his clients.

Previous discipline: Kern was suspended from the practice of law for 90 days in February 2012 for failing to provide a written response to an ODC investigation and to appear as required. In the underlying investigation, Kern admitted that he knowingly allowed the commingling of trust account funds with his own personal funds, but no evidence of misappropriation was found.
