Background: In April 2002, the South Carolina Supreme Court suspended Newell from the practice of law for nine months. Newell filed a petition for reinstatement pursuant to Rule 33, RLDE, and Rule 413, SCACR. After referral to the Committee on Character and Fitness, the committee filed a report and recommendation that the court reinstate Newell to the practice of law and require him to enter into a repayment plan with the Commission on Lawyer Conduct in order to reimburse $12,500 the Lawyers’ Fund for Client Protection paid on claims filed by his prior clients. The court granted the petition for reinstatement upon the condition that, within 30 days, Newell enter into a repayment plan with the commission to reimburse the fund for the $12,500 it paid on claims relating to him.
